A unique collection of moldavites from the world-famous Besednice locality

The subject of the auction is the largest collection of moldavites in the world - a set of 34,313 pieces (141.0257 kg), which are divided into 14 auctions by 10,073.3 grams each. Each of the auctions has the same representation of weight categories.
This is the majority of extracted production in the Besednice locality which is the world most important source of highly valued moldavites. This site was legally mined at the beginning of the millennium, moldavites have been stored for a long time, and they are now for sale.
The Besednice moldavites were discovered at the place of original fall zone so unlike other localities they did not undergo any geological transport and therefore have the most significantly developed surface morphology and the most beautiful shapes. Due to the characteristic appearance it is not possible to plausibly fake the Besednice moldavites. Sometimes moldavites from other localities are offered as those from Besednice, however the typical 'hedgehog-like' shapes are unmistakable.
The authenticity and quality of these moldavites is confirmed by an expert opinion (see in appendix) of the best Czech expert witness and world-renowned expert who examined e.g. gems on historical objects in Czech Republic (Crown of Saint Wenceslas, Coronation Cross of Bohemia, reliquary of St. Maurus, St. Vitus treasury, etc.), as well as abroad (the crown of Rudolph II in Vienna, the cross of King Ottokar I. in Regensburg, Ordre de la Toison d'or in Dresden, etc.).

Moldavites are gemstones which were formed as a result of a meteorite impact that occurred about 15 million years ago. Czech moldavites are the only European tektites and the only gem quality tektites in the world with such a beautiful green colour.
Moldavites are very popular in jewelry, but also among collectors and investors, recently they are increasingly used in esoteric circles.
Over millions of years geological strata with moldavites have been eroded or covered with younger sediments. As a result moldavites are very rare today and only in small areas. The source of the most valuable moldavites is the Besednice locality in southern Bohemia. Their number was very limited by the relatively small scale of the locality. At present there is no chance to find more pieces, therefore in the near future we can expect price growth of Besednice moldavites even faster than moldavites of normal quality.
Like commodities which are commonly considered a financial standard (gold, silver, platinum, diamonds) moldavites too have analogous characteristics:
Moldavites are defined by the circumstances of their origin and no new stones will emerge. Their quantity is sufficient for the market to exist and prosper, but 'small' enough to keep their exceptional market position and therefore their price.
The moldavite deposits are now considerably depleted due to the 'moldavite fever' in recent years; due to current legislation the opening of new sand pits is extremely unlikely and therefore no new resources will appear! Hence the number of moldavites available on the market will continue to decline and it is highly probable that their price will continue to rise.
The offer is unique in its unprecedented amount. The vast majority of Besednice moldavites available in past already found their home in private collections, therefore this auction is most likely the last chance to acquire a larger quantity. A rare opportunity that has never occurred on this scale and will never happen again.
Due to rising prices in recent years the investment can become highly profitable even in a relatively short time.
The whole collection is stored in a secure vault in the center of Prague (Czech Republic) and any interested party can view it in person by appointment and, of course, under appropriate security measures.

Auction decree
in accordance with § 1746 paragraph 2 of Act No. 89/2012 Coll., of the Civil Code, as amended (hereinafter referred to as "the Civil Code") (hereinafter referred to as the "Auction Decree")
1. Basic provision
This auction is conducted at the request and on the authority of the owner of the Subject of the auction, as this term is defined below (hereinafter referred to as the "Owner").
The announcer of this auction is [Lyons Weinberg Czech s.r.o.] (hereinafter referred to as the "Announcer").
This is not an auction within the meaning of Act No. 26/2000 Coll., on public auctions, as amended.
After the end of the auction, a purchase agreement will be concluded between the auction participant who made the best offer (hereinafter referred to as the "Auction Winner") and the Owner, which will take into account the basic conditions specified in Article 7 of this Auction Decree (hereinafter referred to as the "Purchase Agreement").
2. Subject of the auction
The subject of the auction is a set of movable property - a collection of vltavíns (hereinafter referred to as the "Subject of the auction"), as specified in detail in Appendix No. 1 - expert opinion 889/21, drawn up by expert Dr. Jaroslav Hyršlem, ID: 49345893, with registered office at Ke Kurtům 383, 142 00 Prague 4, of this Auction Decree (hereinafter referred to as the "Expert's Opinion").
No rights or obligations of third parties are associated with the Subject of the auction and no legal defects are attached to it.
Inspection of the auction object is possible by prior agreement and it is necessary to notify it at least 3 working days in advance at the email address aukceweinberg@gmail.com. The subject of the auction is auctioned as an integral set.
3. Auction form
The auction will take place in the form of an English auction, where the lowest bid is determined and the highest bid will be considered the best bid. The auction will be conducted electronically. Limitation will be available before the start of the auction. For details on limiting, see https://www.aukceweinberg.cz .
4. Place, date and time of the start of the auction
The auction takes place via the electronic auction system on the portal: www.aukceweinberg.cz on 27 July 2022 from 21:00. It will be possible to use limits even before the start of the auction. The option to limit will be enabled from 27/07/2022 until 21:00 until the start of the auction.
5. Lowest submission and minimum bid
The lowest submission amounts to CZK 15,000,000 (in words: fifteen million Czech crowns) (hereinafter referred to as the "Lowest Submission").
The lowest bid amounts to CZK 100,000 (in words: one hundred thousand Czech crowns).
The starting price for the Subject of the auction will correspond to the amount of the Lowest Bid, or the amount of the current price achieved within the limit, whichever is higher at the time of the start of the auction.
6 The course of the auction
The auction will start as stated in Article 4.1 of this Auction Decree. The auction will be terminated as stated in Article 4.1 of this Auction Decree. However, if a bid is made in the last 3 minutes, the end of the auction is always extended by 3 minutes. The winner of the auction will be the auction participant who made the highest bid at the time of the end of the auction. If several participants of the auction make a bid at the same time and if no bid was made higher, it will be decided by lot which of them will become the Auction Winner. The winner of the auction will be the auction participant with the highest lottery number.
7. Basic conditions of the purchase contract
The purchase contract will be concluded no later than one month from the end of the auction. The purchase price for the Auction Item (hereinafter referred to as the "Purchase Price") will correspond to the best offer made by the Auction Winner (hereinafter referred to as the "Acquirer"). The purchase price cannot be subsequently reduced. The purchase price will be paid free of any deductions of taxes, levies, fees, duties or any other charges. The purchase price will be paid within [10] days from the date of conclusion of the Purchase Agreement, either to the legal escrow account of the lawyer designated by the Owner, or to the bank account of the Owner. The purchase price cannot be paid by offsetting. Payment of the purchase price by means of a bill of exchange, payment card or check is not permitted. The purchase price will be considered paid at the time it is credited to the Owner's bank account or the attorney's escrow account in the sense of Article 7.4 of this Auction Decree. The responsibility of the Owner for defects of the Subject of the auction will be excluded and the Purchaser waives all his rights from defective performance. The subject of the auction will be handed over to the Purchaser within 20 days from the date of payment of the Purchase Price. Ownership of the Auction Item and the risk of damage to the Auction Item shall pass to the Purchaser at the time of delivery of the Auction Item.
8. Auction security Auction security is not required.
9. Method of registration of auction participants
To participate in the auction, it is necessary to be registered on the portal https://aukceweinberg.cz/. The announcer reserves the right to refuse the registration of any participant even without giving a reason.
10. Failing the auction
The auction participant, who failed the auction by not concluding the Purchase Agreement and/or not paying the Purchase Price within the specified period, is obliged to pay the costs of the auction at the request of the Announcer; this also applies to the costs of a repeat auction held as a result of the failure of the previous auction by the Auction Winner.
11. The costs of handing over the Subject of the auction
All costs associated with handing over and taking over the Auction Item are borne by the Auction Winner.
12 Tax aspects and fees
The lowest submission, the minimum bid and the purchase price are understood to include VAT in the legal amount for the subject of the auction, where this VAT comes into consideration.
13. Personal data
The publisher protects the personal data of natural persons provided to him through the portal https://aukceweinberg.cz/ and processes them as an administrator in accordance with Act No. 110/2019 Coll., on the processing of personal data, as amended, and the regulation of the European of the Parliament and the Council 2016/679 of 27 April 2016, on the protection of natural persons in connection with the processing of personal data and on the free movement of such data. The announcer, as administrator, processes the personal data of registered auction participants, only to the extent that the auction participant has provided it himself, in particular first and last name, date of birth, or social security number, residential address, likeness, other identification data and copies of personal documents obtained in accordance with Act No. 253/2008 Coll., on certain measures against the legalization of proceeds from criminal activity and the financing of terrorism, and e-mail address, payment information and others. Personal data is processed for the purpose of administering this auction and fulfilling the contractual obligations arising from it. The advertiser will keep all personal data, including identification data, copies of documents and documents obtained from the portal https://aukceweinberg.cz/ for a period of 10 years.
14. Final Provisions
The Declarant expressly declares that the Owner is not obliged to conclude a Purchase Agreement with the Auction Winner, even without giving a reason. In such a case, the Auction Winner will not have any claim against the Owner and/or the Auction Announcer, and if the Auction Winner should have any claim in this connection, the Auction Winner hereby irrevocably waives it, especially, but not exclusively, in relation to compensation for any damage. The advertiser is entitled to withdraw from this auction at any time, without giving reasons. The purchase of the Auction Item in this auction, as well as the related legal relations, are governed by Czech law. Disputes arising from the auction are resolved by the substantively competent court based on the seat of the Advertiser. In the event that the auction participant enters into a contractual relationship with the Advertiser in connection with this auction as a consumer, he may, in accordance with § 20d et seq. of Act No. 634/1992 Coll., on consumer protection, as amended, to resolve disputes arising from this contractual relationship out of court, namely at the Czech Trade Inspection (www.coi.cz), with registered office at Štěpánská 567/15, 120 00 Prague 2. This does not affect the possibility of the auction participant to assert his claims through court. When exporting the Subject of the auction abroad, it is necessary to obtain a certificate according to Act No. 71/1994 Coll., on the sale and export of objects of cultural value, as amended.
This Auction Decree is drawn up in Czech and English. In the event of a discrepancy between the Czech and English versions of the text, the Czech version takes precedence.
Annex No. 1 – Expert opinion is an integral part of this Auction Decree.
Aukční vyhláška
v souladu s § 1746 odst. 2 zákona č. 89/2012 Sb., občanského zákoníku, v platném znění (dále jen „OZ“)
(dále jen „Aukční vyhláška“)
Základní ustanovení
Tato aukce je prováděna na žádost a z pověření vlastníka Předmětu aukce, jak je tento pojem definován níže (dále jen „Vlastník“).
Vyhlašovatelem této aukce je [Lyons Weinberg Czech sro] (dále jen „Vyhlašovatel“).
Nejedná se o dražbu ve smyslu zákona č. 26/2000 Sb., o veřejných dražbách, v platném znění.
Po skončení aukce bude mezi účastníkem aukce, který učinil nejlepší nabídku (dále jen „Vítěz aukce“), a Vlastníkem, uzavřena kupní smlouva, která bude zohledňovat základní podmínky uvedené v čl. 7 této Aukční vyhlášky (dále jen „Kupní smlouva“).
Předmět aukce
Předmětem aukce je soubor movitých věcí – sbírka vltavínů (dále jen „Předmět aukce“), jak je tento podrobně specifikován v příloze č. 1 - znaleckém posudku 889/21, vypracovaném znalcem Dr. Jaroslavem Hyršlem, IČ: 49345893, se sídlem Ke Kurtům 383, 142 00 Praha 4, této Aukční vyhlášky (dále jen „Znalecký posudek“).
S Předmětem aukce nejsou spojena žádná práva ani závazky třetích osob a neváznou na něm žádné právní vady.
Prohlídku Předmětu aukce je možná po předchozí dohodě a je nezbytné ohlásit ji alespoň 3 pracovní dny předem na emailové adrese [aukceweinberg@gmail.com].
Předmět aukce je dražen jako nedílný soubor.
Forma aukce
Aukce bude probíhat formou anglické aukce, kdy je stanoveno nejnižší podání a za nejlepší nabídku bude považována nabídka nejvyšší.
Aukce bude prováděna elektronicky.

Místo, datum a čas zahájení aukce
Aukce se koná prostřednictvím elektronického systému aukcí na portálu: www.aukceweinberg.cz dne 27. 7. 2022 od [21:00] hod do [?] hod.
Již před zahájením aukce bude možné využít limitování. Možnost limitovat bude umožněna ode dne 27. 7. 2022 do 21:00 hod do zahájení aukce.
Nejnižší podání a minimální příhoz
Nejnižší podání činí částku ve výši 15.000.000,- Kč (slovy: patnáct milionů korun českých) (dále jen „Nejnižší podání“).
Nejnižší příhoz činí částku ve výši 100.000,- Kč (slovy: sto tisíc korun českých).
Vyvolávací cena za Předmět aukce bude odpovídat výši Nejnižšího podání, nebo výši aktuální ceny dosažené v rámci limitování, podle toho, které bude k okamžiku zahájení aukce vyšší.
Průběh aukce
Aukce bude zahájena, jak je uvedeno v čl. 4.1 této Aukční vyhlášky.
Aukce bude ukončena, jak je uvedeno v čl. 4.1 této Aukční vyhlášky. Pokud však bude v posledních 3 minutách proveden příhoz, konec aukce se prodlužuje vždy o 3 minuty.
Vítězem aukce se stane ten účastník aukce, který v době ukončení aukce učinil nejvyšší podání.
Základní podmínky kupní smlouvy
Kupní smlouva bude uzavřena nejpozději do jednoho měsíce ode dne ukončení aukce.
Kupní cena za Předmět aukce (dále jen „Kupní cena“) bude odpovídat nejlepší nabídce učiněné Vítězem aukce (dále také „Nabyvatel“). Kupní cenu nelze dodatečně snížit.
Kupní cena bude uhrazena prosta jakýchkoli srážek daní, odvodů, poplatků, cel nebo jakýchkoli jiných poplatků.
Kupní cena bude uhrazena do [10] dnů ode dne uzavření Kupní smlouvy, a to buď na účet advokátní úschovy advokáta určeného Vlastníkem, nebo na bankovní účet Vlastníka. Kupní cenu nelze uhradit započtením. Úhrada Kupní ceny prostřednictvím směnky, platební karty či šeku je nepřípustná.
Kupní cena se bude považovat za uhrazenou v okamžiku jejího připsání na bankovní účet Vlastníka, nebo účet advokátní úschovy ve smyslu čl. 7.4 této Aukční vyhlášky.
Odpovědnost Vlastníka za vady Předmětu aukce bude vyloučena a Nabyvatel se vzdá veškerých svých práv z vadného plnění.
Předmět aukce bude Nabyvateli předán do 20 dnů ode dne uhrazení Kupní ceny.
Vlastnické právo k Předmětu aukce a nebezpečí škody na Předmětu aukce přejdou na Nabyvatele v okamžiku předání Předmětu aukce.
Aukční jistota
Aukční jistota se nepožaduje.
Způsob registrace účastníků aukce
Pro účast v aukci je nezbytné být zaregistrován na portálu https://aukceweinberg.cz/ .
Vyhlašovatel si vyhrazuje právo odmítnout registraci kteréhokoliv účastníka i bez udání důvodu.
Zmaření aukce
Účastník aukce, který zmařil aukci tím, že neuzavřel Kupní smlouvu a/nebo neuhradil ve stanovené lhůtě Kupní cenu, je povinen na vyzvání Vyhlašovatele uhradit náklady aukce; to platí i pro náklady opakované aukce konané v důsledku zmaření předchozí aukce Vítězem aukce.
Náklady předání Předmětu aukce
Veškeré náklady spojené s předáním a převzetím Předmětu aukce nese Vítěz aukce.
Daňové aspekty a poplatky
Nejnižší podání, minimální příhoz i Kupní cena se rozumí včetně DPH v zákonné výši u Předmětu aukce, kde toto DPH přichází v úvahu.
Osobní údaje
Vyhlašovatel chrání osobní údaje fyzických osob, které mu byly poskytnuty prostřednictvím portálu https://aukceweinberg.cz/ a zpracovává je jakožto správce v souladu se zákonem č. 110/2019 Sb., o zpracování osobních údajů, v platném znění, a nařízením Evropského parlamentu a Rady 2016/679 ze dne 27. 4. 2016, o ochraně fyzických osob v souvislosti se zpracováním osobních údajů a o volném pohybu těchto údajů.
Vyhlašovatel jakožto správce zpracovává osobní údaje registrovaných účastníků aukce, a to pouze v tom rozsahu, v jakém je účastník aukce sám poskytl, zejména jméno a příjmení, datum narození, případně rodné číslo, adresu bydliště, podobiznu, další identifikační údaje a kopie osobních dokladů získané v souladu se zákonem č. 253/2008 Sb., o některých opatřeních proti legalizaci výnosů z trestné činnosti a financování terorismu, a e-mailovou adresu, platební údaje a další.
Osobní údaje jsou zpracovávány z titulu a pro účely administrace této aukce a plnění smluvních závazků z ní plynoucích.
Vyhlašovatel bude veškeré osobní údaje, včetně identifikačních údajů, kopií dokladů a dokumentů získaných z portálu https://aukceweinberg.cz/ uchovávat po dobu 10 let.
Závěrečná ustanovení
Vyhlašovatel výslovně prohlašuje, že Vlastník není povinen s Vítězem aukce Kupní smlouvu uzavřít, a to i bez udání důvodu. Vítěz aukce v takovém případě nebude mít proti Vlastníkovi a/nebo Vyhlašovateli aukce jakýkoliv nárok, a pokud by Vítězi aukce jakýkoliv nárok v této souvislosti vznikl, Vítěz aukce se jej tímto neodvolatelně vzdává, zejména, nikoliv však výlučně, ve vztahu k náhradě jakékoliv škody.
Vyhlašovatel je oprávněn kdykoliv od této aukce upustit, a to bez udání důvodů.
Koupě Předmětu aukce v této aukci, jakož i právní vztahy s tím související, se řídí českým právem.
K řešení sporů z aukce je příslušný věcně příslušný soud dle sídla Vyhlašovatele.
V případě, že účastník aukce vstupuje do smluvního vztahu s Vyhlašovatelem v souvislosti s touto aukcí v postavení spotřebitele, může v souladu s § 20d a násl. zákona č. 634/1992 Sb., o ochraně spotřebitele, v platném znění, řešit spory vzniklé z tohoto smluvního vztahu i mimosoudně, a to u České obchodní inspekce (www.coi.cz), se sídlem Štěpánská 567/15, 120 00 Praha 2. Tímto není dotčena možnost účastníka aukce uplatňovat své nároky soudní cestou.
Při vývozu Předmětu aukce do zahraničí je nezbytné opatřit si osvědčení podle zákona č. 71/1994 Sb., o prodeji a vývozu předmětů kulturní hodnoty, v platném znění.
Tato Aukční vyhláška je vyhotovena v českém a anglickém jazyce. V případě rozporu mezi českou a anglickou verzí textu má přednost česká verze.
Nedílnou součástí této Aukční vyhlášky je její příloha č. 1 – Znalecký posudek.
